_alfresco.url locked when CIFS mounted by Mac

Current Setup is 3.4d with authentication.chain= alfist:alfresco, ldap1:ldap-ad, passthru1assthru
When I mount alfresco as a CIFS volume on mac, the _alfresco.url file is locked and prevents me from deleting the folder? I found the issue in an older version 2.1, it was marked as resolved with no solution? I have permission to add/delete/modify these files if I mount it as CMIS or webdav. Any help is greatly appreciated.

Update.
I have done a standard install of Alfresco 3.4d. No modifications. I mount the repository as CIFS as the admin, and the _alfresco.url, _checkin.exe, and _checkout.exe files are locked by default. I am unable to delete any folder or directory. I have no problem deleting files, adding files, coping or moving directories, and no problems creating new directories. I just can't delete them? Anyone having simliar issues. Here is the link to the bug report I found for an earlier version.
